Terms and Conditions
Article 1 – Definitions
In these General Terms and Conditions, the following terms are defined as described below:
Cooling-off period:
The period within which the consumer may exercise their right of withdrawal.
Consumer:
A natural person who is not acting for business or professional purposes and who enters into a distance contract with the company.
Day:
A calendar day.
Durable medium:
Any means that enables the consumer or the company to store information addressed personally to them in a way that allows access and reproduction of the information unchanged in the future.
Right of withdrawal:
The consumer’s right to terminate the distance contract within the cooling-off period.
Company:
A natural or legal person who offers products and/or services to consumers through distance selling.
Distance contract:
A contract concluded as part of a distance selling system organised by the company, using one or more means of remote communication, up to and including the conclusion of the contract.
Means of communication:
Any medium that can be used to conclude an agreement without the consumer and the company being physically present in the same place.

Article 3 – Scope
These General Terms and Conditions apply to every offer from the company, as well as to every distance contract and order concluded between the company and the consumer.
Before the conclusion of a distance contract, the consumer must have access to the text of these General Terms and Conditions.
If this is not reasonably possible, the consumer must be informed of where the Terms and Conditions can be accessed and that they will be provided free of charge upon request.
If the distance contract is concluded electronically, these Terms and Conditions may be made available in a manner that allows the consumer to store them on a durable medium.
Article 4 – Offers
The offer must contain a complete and accurate description of the products and/or services being offered.
Obvious mistakes or typographical errors in the offer are not binding for the company.
All images, technical information, and descriptions included in the offer are for illustrative purposes only and do not give rise to any right to compensation or cancellation of the contract.
Article 5 – Prices

All prices stated in the offer include VAT (Value Added Tax) unless otherwise specified.

Any additional costs, such as shipping, customs duties, or administrative fees, will be clearly indicated before the order is confirmed.

Montgomery London reserves the right to adjust prices at any time; however, the prices applicable at the time of ordering will remain valid for that order.

Obvious pricing errors or misprints are not binding for the company.
Article 6 – Agreement

The agreement becomes effective once the consumer accepts the offer and meets the applicable terms and conditions.

When the consumer places an order electronically, Montgomery London shall confirm receipt of the order without delay.

Montgomery London reserves the right to refuse an order in cases such as stock unavailability, suspicion of fraud, or incorrect customer details.

Once confirmed, the consumer will receive a digital order confirmation and invoice by email.
Article 7 – Payment

Payments must be made using the available secure payment methods displayed at checkout.

The consumer must ensure that all payment details are accurate and that sufficient funds are available.

If payment is not received or is reversed, Montgomery London reserves the right to cancel the order or withhold delivery until payment is completed.

Refunds will be processed using the same payment method used for the original purchase.
Article 8 – Delivery and Execution

Montgomery London will exercise the utmost care when processing and delivering orders.

Orders are dispatched to the delivery address provided by the consumer. The consumer is responsible for ensuring that the address is correct.

Delivery times stated are indicative and may vary due to external factors such as customs clearance or carrier delays.

If delivery is delayed or a product is unavailable, Montgomery London will inform the consumer as soon as possible. In such cases, the consumer may choose to wait, receive an alternative product, or cancel the order for a full refund.

The risk of loss or damage to the products passes to the consumer once the order has been delivered.
Article 9 – Right of Withdrawal

The consumer has the right to withdraw from the contract within 30 days of receiving the goods, without providing a reason.

To exercise this right, the consumer must notify Montgomery London by email at support@montgomerylondon.com within the 30-day period.

Returned items must be unused, unwashed, and in their original condition and packaging.

The consumer is responsible for return shipping costs to our warehouse in China, unless otherwise stated.

Refunds will be processed within 7 business days after the returned items have been received and inspected.

Shipping costs are non-refundable unless the return is due to an error by Montgomery London or a defective product.
Article 10 – Liability

Montgomery London is not liable for indirect or consequential losses, including but not limited to loss of profit, loss of data, or loss due to delay.

The company’s total liability for any claim shall not exceed the total amount paid by the consumer for the order in question.

Montgomery London is not responsible for damage caused by improper use, lack of care, or failure to follow product instructions.

Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, or any other liability that cannot legally be excluded.
Article 11 – Warranty and Conformity

Montgomery London guarantees that the products supplied meet the specifications stated in the offer and are free from defects at the time of delivery.

If a product is defective or does not meet expectations, the consumer must notify Montgomery London in writing via support@montgomerylondon.com within a reasonable time after discovering the issue.

Upon verification, Montgomery London may offer a replacement, repair, or refund, depending on the situation.

The warranty does not apply if:

The defect is caused by normal wear and tear;

The consumer has modified, damaged, or misused the product;

The product has not been handled according to care instructions.

This warranty does not affect the consumer’s statutory rights under applicable consumer protection laws.
Article 12 – Complaints Procedure

The consumer must submit any complaints as soon as possible, and no later than 14 days after the issue arises.

Complaints must be sent by email to support@montgomerylondon.com, clearly describing the issue and including the order number.

Montgomery London will acknowledge receipt of the complaint within 3 business days and aim to resolve it within 14 days.

If the complaint cannot be resolved within this period, the consumer will be informed of the reason for the delay and given an estimated timeframe for resolution.

If the dispute cannot be resolved amicably, it may be submitted to the appropriate court as described in Article 15.
Article 13 – Intellectual Property

All intellectual property rights, including but not limited to trademarks, designs, images, text, and other materials on the website, remain the exclusive property of Montgomery London or its licensors.

The use, reproduction, or distribution of any content from the website without prior written consent from Montgomery London is strictly prohibited.

Consumers may not use the company’s intellectual property for commercial purposes without explicit permission.
Article 14 – Force Majeure

Montgomery London shall not be held liable for delays or failure to fulfil its obligations caused by circumstances beyond its reasonable control, including but not limited to: natural disasters, war, strikes, transport disruptions, government restrictions, or technical failures.

In the event of force majeure, Montgomery London will inform the consumer as soon as possible. Both parties may agree to suspend the contract or cancel it without any obligation to pay damages.
Article 15 – Governing Law and Dispute Resolution

These General Terms and Conditions are governed by and construed in accordance with the laws of The Netherlands.

Any disputes arising from or relating to these Terms and Conditions shall be submitted exclusively to the competent court in Amsterdam, The Netherlands, unless mandatory consumer law dictates otherwise.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue to apply in full force.
